There are two options available to you if your lender has not
resolved your mortgage arrears claim and you have exhausted their
complaints process.
Firstly, you can forward your complaint to the Financial
Ombudsman Service (FOS). The FOS is an independent body
set up by the government to resolve disputes between financial
institutions and customers. Their service is completely free and is
relatively easy to use.
When you contact the FOS they will send out a form to you which
you complete and send back along with all the correspondence
between you and your lender. The FOS will then judge your case
independently and if it's deemed that the lender charged you
unfairly they will be obliged to refund you in full.
The second option is to take your claim to the small
claims court. If your claim is for under £5000 (£750 in
Scotland, £2000 in Northern Ireland) then you may issue legal
proceedings against your lender. For more information on how to
