It is unfortunately the case that many people living in the UK have had their needs and care assessed incorrectly by local health authorities and below are just a few of these people who have rightly taken issue with their care home fees and who have been awarded compensation.

In the case of Judith Roe, who sadly died last October, the sum of £130,000 was reclaimed from her local NHS when they wrongly classed her Alzheimers and associated medical problems as 'social' rather than 'health related'. She had to sell her own home to help pay for her care home fees.

Rod Johnson won back £51,500 when he was left partially paralysed following a brain haemorrhage and the local care trust did everything possible to prevent paying out. His brother Stephen said, "My message to people is, if they are unsure whether they are due free care, then take advice, because the NHS won't offer it easily".

Finally comes the case of Marjorie Eyton-Jones, also an Alzheimer's sufferer. After 6 years, the family of Mrs Eyton-Jones received £165,000 which the NHS admitted the family had been wrongly charged for. The family were told Mrs Eyton-Jones required 24 hour nursing care, but because she had available savings of at least £23,000, they were told they had to fund the care themselves, no other option was given. They recovered the entire amount of the nursing fee costs.
