Care Homes and Continuing Care

A lot of people don't know it but if they or their relative have gone into a care home and the main reason is health related - physical or mental, then the local authority should foot the bill.  Thousands of people are claiming back millions.

It all goes back to an important court case called Coughlan in 1999 which ruled that healthcare in the UK was a taxable benefit like hospitals and your GP.  If a person needs to leave their home due to health (very often the case), then that person should not have to pay an average of £692 a week, as they have already paid tax all their life (or at least their generation has.)

It is quite remarkable that thousands, or even hundreds of thousands of people were either never assessed, or never assessed properly, meaning they have spent sometimes their entire life's savings on a care home rather than leaving it to their loved ones or their favourite charity.
